General terms and conditions

1. Provider & scope
1.1.
Your Dubai Car offers automotive purchasing and advisory services. In addition, Your Dubai Car can offer other free and paid services.

1.2.
The General Terms and Conditions apply to customers who have chosen an offer from Your Dubai Car. Your Dubai Car offers its services to both private individuals and companies. These must have unlimited legal capacity and be natural persons, partnerships or legal entities.

1.3.
These terms and conditions apply. Different terms and conditions do not apply.

2. Changes to the General Terms and Conditions
2.1.
Your Dubai Car may adapt the Terms and Conditions if necessary, for example due to legal changes or further developments to the services. New terms and conditions will be published on the website and can be objected to within two weeks after they come into force.

3. Conclusion of contract
3.1.
Customers receive a written invoice when booking services. A revocation is possible within 14 days. If Your Dubai Car begins the work before this deadline, the customer is obliged to pay for the work performed.

3.2.
In the event of third-party claims against the customer due to the use of Your Dubai Car services, the customer must immediately indemnify Your Dubai Car.

3.3.
Your Dubai Car may temporarily suspend work until claims are resolved.

4. Subject of the contract
4.1.
The booked services are described in the invoice.

4.2.
Offers and services are described on yourdubaicar.com. Changes or discontinuation of services are possible.

4.4.
Your Dubai Car may commission third parties to provide services. The customer has no right to information about third parties.

4.5.
No guarantees of success are given. The customer is responsible for achieving his goals.

4.6.
Your Dubai Car may use anonymized customer information for marketing purposes. Data deletion must be explicitly requested.

4.7.
Your Dubai Car requires all relevant data and information from the customer to provide the service. Missing information releases Your Dubai Car from its obligation to provide services.

4.8.
Dates and deadlines are specified in the order confirmation or invoice. Your Dubai Car will inform you about any appointment changes.

5. Duration of contract and termination
5.1.
The contract with Your Dubai Car is concluded for the duration of the car purchase advisory service used and ends automatically when it is completed.

5.2.
Booking advisory services, vehicle inspections or other services with Your Dubai Car results in a contractual relationship for the use of these specific services. Bookings are made directly via the website, via the inquiry form, email, telephone, WhatsApp or SMS. A contract is concluded with written confirmation by Your Dubai Car and the customer. For services paid for online, the contract comes into force immediately.

5.3.
There is no set notice period. Cancellation is possible at any time, but must be done before the booked service expires. Cancellations must only be made in writing by email to the Your Dubai Car address given in the legal notice.

5.4.
If a contract is not terminated in a timely manner in accordance with point 5.3, it will automatically be extended by the original term.

5.5.
For good cause, both parties can terminate the contract at any time without notice. An important reason exists if one of the contracting parties finds it unreasonable to continue the contract until the notice period has expired.

5.6.
If the customer withdraws from an order, Your Dubai Car will charge cancellation fees: up to six months before the start of the order 10%, from six to three months before 25%, from three months to four weeks before 50%, from four weeks to two weeks before 80% and from two weeks before the start of the order 100% of the order value.

6. Prices and payment
6.1.
The prices for Your Dubai Car services can be viewed on the website or calculated individually based on customer orders. All prices are net prices plus the VAT applicable at the time of payment. The payment deadline is stated on the invoice.

6.2.
Payment terms for Your Dubai Car services are determined individually. Payments can be made in advance, partially in advance and after the service has been provided, or in full after the service has been provided. Advance payments during a project are possible. The payment terms are stated on the invoice.

6.3.
Payments are made by bank transfer, credit card or cash. The customer authorizes Your Dubai Car to collect payments due. The service will be provided after receipt of payment. If paying in cash, the customer receives a written receipt.

6.4.
The customer bears the full costs for debt collection, in particular return direct debits.

6.5.
If the customer defaults on payment, Your Dubai Car can stop services and withhold documents until the debt has been repaid. The customer bears all costs of late payment. If there is a delay of more than ten days after a reminder, Your Dubai Car is entitled to extraordinary termination.

6.6.
Price changes for services are possible at any time; existing contracts remain unaffected.

7. Warranty
7.1.
Your Dubai Car ensures that the services offered can be used in accordance with the contract to the agreed extent and without violating the rights of third parties. Your Dubai Car guarantees this.

7.2.

If there are defects in the vehicles provided, Your Dubai Car will offer repairs or a reasonable price reduction. The decision on how to remedy the defect lies with Your Dubai Car. A final declaration of failure to remedy the defect will only be made if Your Dubai Car finally stops or unreasonably delays the remedy.

7.3.
In the event of violations of third party intellectual property rights that delay the provision of the service, Your Dubai Car will either acquire the rights for further use or offer an alternative solution. If this is not possible, both parties can terminate the contract. In such cases, Your Dubai Car releases the customer from third-party claims.

8. Liability
8.1.
Your Dubai Car is fully liable for injuries to life, body or health and for intent or gross negligence.

8.2.
In the case of simple negligence, Your Dubai Car is only liable for breach of essential contractual obligations and is limited to the typically foreseeable damage.

8.3.
Liability for non-essential contractual obligations in the event of slight negligence is excluded.

8.4.
Any further liability of Your Dubai Car for damages is excluded.

8.5.
The limitation of liability also applies to employees, representatives and vicarious agents of Your Dubai Car.

8.6.
In the event of force majeure that makes the provision of services difficult or impossible, Your Dubai Car is entitled to delay the fulfillment of its obligations.

8.7.
Your Dubai Car assumes no liability for the customer’s technical infrastructure.

9. Copyright
9.1.
The Your Dubai Car website and all content and services offered there are protected by copyright. This also includes all texts, images and other materials created by Your Dubai Car.

10. Data protection
10.1.
Customers’ personal data will be processed by Your Dubai Car in accordance with applicable data protection regulations.

10.2.
Your Dubai Car strives for secure data transmission, but cannot guarantee the complete security of data transmission over the Internet.

10.3.
Your Dubai Car may pass on personal data to subcontractors to the extent this is necessary for the fulfillment of the contract. When the contract is terminated, customers can request that their data be deleted.

10.4.
Copying, modifying or otherwise using any content on the Your Dubai Car website without prior permission is prohibited.

10.5.
Your Dubai Car’s privacy policy can be viewed on the website and governs the use and processing of personal data.

11. Confidentiality
11.1.
All information accessible as part of the contractual relationship must be treated confidentially by Your Dubai Car and the customer.

11.2.
Your Dubai Car obliges all employees involved to comply with confidentiality agreements.

12. Final provisions and miscellaneous
12.1.
The place of jurisdiction for disputes arising from the contractual relationship is Your Dubai Car’s headquarters in the United Arab Emirates.

12.2.
The law of the United Arab Emirates applies exclusively to the contractual relationship.

12.3.
If individual provisions of the contract are invalid, the effectiveness of the remaining provisions will not be affected. Invalid provisions will be replaced by effective ones that come closest to the economic purpose.

12.4.
Your Dubai Car is entitled to use the customer’s name and logo and other anonymized data in reference lists.
